About the Terms 

This website is provided and operated by Australia for Dolphins Limited, trading as Action for Dolphins (Action for Dolphins, we, us, our).  Action for Dolphins is incorporated in Australia and registered as a charity with the Australian Charities and Not-for-profits Commission. Action for Dolphins’ headquarters is at 17/31 Queen Street, Melbourne, Victoria, Australia. 

The terms of use (Terms) explain how you may use the website www.afd.org.au and any site owned or operated by Action for Dolphins (Site), which is provided to you free of charge. The Terms also apply to any text, images, video, audio or other multimedia content, or other information or material on the Site (Content). 

You should read the Terms carefully before using the Site. By accessing or using the Site or otherwise indicating your consent, you agree to be bound by the Terms and the documents referred to in them.  If you do not agree with or accept any of the Terms, you should stop using the Site immediately. 

Please read the Terms carefully, along with our Privacy Policy and Cookies Policy, to understand how we collect, use and store your personal data, and the conditions that apply when using the Site or the Content. 

 

Using the Site

We encourage you to use the Site to educate yourself and others, to promote Action for Dolphins’ work or to fundraise for us. 

When doing so you are bound by the following limitations:

  • You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Site.
  • The Site is intended for use only by those who can access it within Australia. If you choose to access the Site from locations outside Australia, you are responsible for compliance with local laws where they are applicable.

The Site, the Content and all intellectual property rights in them, are owned by Action for Dolphins, our licensors, or both (as applicable).

We and our licensors reserve all of our and their rights in any intellectual property in connection with the Terms. This means, for example, that we and they remain owners of them and free to use them as we and they see fit. 

The following intellectual property rights restrictions apply to your use of the Site and Content: 

  • Commercial use or publication of any or all of the Content is not permitted without prior authorisation from us or the relevant copyright owner. 
  • You will need to get separate permission from the copyright owner of any material marked “source” or “credit” for any use, because it belongs to someone else and we are using it under a licence. 
  • You may print off one copy, and may download extracts, of any page(s) of our Site for your personal private use and you may draw the attention of others within your organisation to Content posted.   • You will make it clear that the link on your website does not mean that we support or endorse what you do, without prior permission from us.

  • You will not change the link in any way or combine it with any other graphics.
  • We can ask you to stop using the link at any time at our complete discretion.
  • You agree we may take action against you if you misuse our Content and any goodwill you generate by using it will belong to us. 
  • You recognise that all appropriate laws (including the laws of the country in which your website originates) also apply.

 

Accuracy and availability of the Site and Content

The Site is provided “as is”. 

While we try to make sure that the Site is available, accurate, up-to-date and free from bugs, we do not warrant that provision of the Site will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs.

Where you post personal information in a comment on the Site, you are making that information publicly available.  You promise that you own any content that you post and you give us, and grant us the right to use any content you might post for any non-commercial purpose.

You promise that all information you provide to us (including your opinions) will be truthful and accurate and that you will not say anything about another person that is not in line with our values or which could be defamatory. We reserve the right to remove any content you post for any reason at any time. 

We take no responsibility for the accuracy, integrity or quality of content posted by others. You view these entirely at your own risk.

We do not control such websites, and are not responsible for their contents. While the Site uses encryption security software in areas where online payment details are accepted, we do not guarantee the security of information and payments transmitted via the internet.

We reserve the right to vary any event registration fees and the prices of any goods or services listed without notice. All event registrations and orders for goods and services are subject to availability. We reserve the right to refuse to accept any registration and to refuse to supply any goods or services to any individual. 

 

Limitation on our liability

Except for any legal responsibility that we cannot exclude at law, we are not legally responsible for any losses that were not foreseeable to you and us when the Terms were formed or that were not caused by any breach on our part.

To the extent permissible under applicable law, we are not legally responsible for any losses or damage incurred or sustained by viruses transmitted via the Site and the Content, or incurred or sustained when transmitting information by email or otherwise over the internet.

 

Events beyond our control

We have no liability to you for any breach of the Terms, or loss or damage which may be suffered by you or any third party due to any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

No changes to the Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary the Terms from time to time. Our updated terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. Jurisdiction

The Terms, their subject matter and their formation, are governed by the laws of Victoria, Australia.  You and we both agree that the courts of Victoria, Australia will have exclusive jurisdiction.
